Author terms

1. Marketplace operator
Miroslav Smik, Petzvalova 332/65, 059 01 Spišská Belá, Slovak Republic, business registration number 54552206, email support@embrixell.com, registered in the Trade Register of the District Office Kežmarok under number 730-19846, is not VAT registered.
2. Author account
The author must provide accurate information, protect their account and complete identity and bank-account verification through Stripe. Sales and payouts are enabled only after successful verification. The author is responsible for their tax, social-contribution and record-keeping obligations.
3. Right to sell
The author may upload only a design for which they hold the necessary rights or have explicit permission to sell and license it. Copies of protected brands, characters, works or personal data without the required consent, unlawful content and files that could damage equipment are prohibited.
4. Licence and delivery
The author grants Embrixell a non-exclusive right to store, display, promote, technically process and deliver the design to the buyer to the extent required to operate the marketplace. The buyer's licence is defined by the product listing and must not conflict with these terms or the law.
5. Price, commission and payout
The author sets the price in euros, with a minimum of €3.99. Embrixell receives the buyer's payment, retains 15% of the gross price and sends 85% to the author's connected account. Embrixell covers payment processing from its share. Stripe manages bank payouts and any reserves according to the status of the author's account.
6. Refunds, disputes and negative balance
Embrixell handles buyers' payment complaints. In the event of a refund, fraud, dispute or breach of these terms, it may revoke access to the file, suspend the listing and reverse or offset the related transfer to the author. If that is insufficient, the amount may create a negative balance on the connected account in accordance with Stripe's rules.
7. Listing review and removal
Embrixell may review a design, request proof of rights, reject or remove a listing and suspend sales where there is suspected infringement of rights, law, security requirements or file-quality rules. The author may request a review at support@embrixell.com.
8. Termination
The author may stop adding listings and request closure of the seller profile after all open payments have been settled. Obligations relating to completed sales, licences, refunds, disputes and retention of accounting records remain in force.
9. Changes to the terms
If the terms change materially, the author's explicit consent will be requested again before another upload or payout. The stored record includes the time and version of the accepted terms.
