1. Seller

The seller operates Embrixell (hereinafter “Embrixell”). A consumer is an individual acting outside their business or profession.
2. What Embrixell supplies
Embrixell converts an image uploaded by the customer into machine embroidery files at the selected size and in an available format, particularly DST, PES, JEF, EXP, VP3, XXX. The result is digital content delivered by download, not physical embroidery.
The preview is a simulation. Thread, fabric, stabiliser, tension, needle and machine settings affect the actual result. Before series production, the customer must check the size, hoop, format and stitch count and test the embroidery on the intended material.
3. Orders and prices
Before placing an order, the customer sees the main output features, compatibility, final price and any subscription period. The order is concluded only by confirming a button labelled “Order with obligation to pay”, or equally clear wording, and successful payment. The customer receives confirmation of the contract and these terms by email or another durable medium.
A one-time order covers one design and the selected size. Subscriptions renew monthly until cancelled. The credit allowance, price and renewal date are shown before payment. Unused credits do not carry over. A subscription may be cancelled before the next renewal date; cancellation stops future payments.
4. Delivery and compatibility
The paid file becomes available after payment is confirmed, normally immediately. The purchase entitlement remains in the customer account. Secure download links are short-lived; after a link expires, the customer can generate a new one from purchase history without another payment or credit. Expiry or cancellation of subscription credits does not remove files already purchased or unlocked. The customer is responsible for choosing a format supported by their machine, hoop and software.
5. Withdrawal from the contract
A consumer generally has 14 days to withdraw from a distance contract. For digital content not supplied on a tangible medium, this right is lost only after delivery begins under the statutory conditions and after the required express consent and acknowledgement. A withdrawal notice may be sent by email to support@embrixell.com; include the order number and an unambiguous withdrawal statement.
6. Licence for the output
After payment, the customer may use the embroidery file for their own embroidery and to make physical embroidered products, including for sale. They may not resell, share, sublicense or make the digital file available as a file. The customer declares that they have the right to use the uploaded image, logo, text and trademarks.
7. Defects in digital content
Embrixell is responsible for conformity of digital content with the contract and the law. These terms cannot restrict statutory rights. If a file cannot be opened in the declared compatible format, is damaged, missing or materially inconsistent with the confirmed order, the customer may report the defect under the complaints procedure. Subject to statutory conditions, they may request conformity, an appropriate price reduction or termination of the contract.
8. Account and storage
The basic preview can be used without a customer account. Saving projects to the cloud, accessing orders and managing subscriptions requires an account with a verified email address. The same account provides access to the customer's saved projects, orders and credits. A project is uploaded only after the save button is used; the customer can reopen, download or delete it from the account after confirmation. Deleting a project does not cancel a subscription or delete the account. Customers should download and securely back up their projects and purchased files.
9. Alternative dispute resolution
If a customer is dissatisfied with the handling of a complaint or believes their rights have been infringed, they may first ask the seller for a remedy. If the seller rejects the request or does not respond within the statutory period, the consumer may apply to the appropriate alternative dispute resolution entity. 10. Final provisions
The contract is governed by Slovak law; this does not deprive consumers of protection under the mandatory rules of their own country. The terms applicable to an order are those communicated before it was submitted. Changes will not retrospectively diminish rights already acquired.
Physical products and production
Before payment the customer sees the seller, named manufacturer and sender, product, embroidery size, price, delivery method and production and delivery estimates. The manufacturer receives only data needed to make, ship and handle claims. Custom placement requires feasibility and final-price approval. The order stores the accepted terms version and confirmed pricing. A reusable digital machine file is not included unless explicitly stated.
